The Patient Protection & Affordable Care Act

USI helps clients understand the risks, navigate the changes and explore potential opportunities in the Patient Protection and Affordable Care Act (ACA). Employers must understand not only the formal elements of reform but anticipate the unintended consequences and potential market shifts in the delivery of healthcare as providers and payers seek to reinvent themselves in a new system governed by changes in regulation and reimbursement.

USI remains on the front edge of legislative changes—our team is regularly quoted in the national media and has provided testimony to the Institute of Medicine around employer attitudes. In addition, we maintain direct ties to federal regulators and industry trade organizations in order to remain at the forefront of current and upcoming laws.

In a time where reform is increasing costs for clients, USI understands these regulatory changes and can leverage underwriting practices to improve pricing and increase control over healthcare consumption.

USI’s legal and compliance team conducted a compliance checklist review for a 350 employee manufacturing company in the Northeast. The Company had limited HR resources devoted to the employee benefits plans. Our analysis identified several gaps, including old or non-existing plan documents, lack of appropriate COBRA and FMLA notifications, and 5500 form filings. USI provided the client with template Wrap and SPD documents, as well as sample notification letters. We assisted in the completion of delinquent filer forms to mitigate non-compliance penalties and invited the client to attend our quarterly compliance update webinar to stay abreast of new relevant compliance requirements. Potential penalties levied by the Department of Labor and IRS for the absence of plan documents and other gaps could have exceeded $150,000. By uncovering these issues and completing the voluntary delinquent filer forms, USI was able to cap the client’s penalties to $4,000 per plan.
